ubAlert’s mission is to help save lives by providing the most up-to-date and accurate incident, hazard, and potential disaster alerting, notification, and information, world-wide.  But, ensuring consistent and reliable global coverage is a huge undertaking, requiring innovative approaches to combine the power of social media, news media, scientific impact modeling, and global and regional observation systems.  ubAlert has the solution.

FOR YOUR OWN BENEFIT, PROTECTION, AND SAFTY, PLEASE REVIEW THIS USER AGREEMENT ("AGREEMENT") AND TERMS (“TERMS” AND/OR “CONDITIONS”) CAREFULLY, AS IT CONSTITUTES A LEGAL AGREEMENT BETWEEN YOU ("YOU" OR “USER”) AND ubALERT (“ubAlert, "WE", OR “COMPANY”) WITH RESPECT TO YOUR USE OF THE COMPANY PROVIDED-SERVICES AND/OR APPLICATIONS (THE "SERVICES").  BY USING THE SERVICES, YOU AGREE TO BE BOUND BY EACH (AND EVERY) OF THE TERMS AND CONDITIONS SET FORTH HEREIN. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU WILL NOT BE ALLOWED TO USE THE SERVICES.

ubAlert provides timely notification of natural and human-caused disaster events.   Subscribers to unAlert may report incidents, sign up to receive these notifications for their geography of interests, and/or login to provide additional content to particular events of interest.  These along with all other features, functions, information, and products provided to the users by the company are collectively referred to as SERVICES.  These services are offered to the users via Internet and/or other communications networks (“NETWORK” OR “ONLINE NETWORK”).

ubAlert is not a news agency and does not normally originate stories by itself.  Besides crowdsourcing (i.e., information provided by the subscribers or registered users), ubAlert collects disaster and hazard information (“INFORMATION”) from various sources that are deemed accurate and reliable.  These include various governmental and/or international agencies, news organizations, university programs, and/or third party information integrators and suppliers.  By integrating all of these data, ubAlert provides a single window for global disaster alerting and notification.

BY USING ANY OF THE ubALERT SERVICES, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, CONCUR, AND COMPLY WITH ALL TERMS AND CONDITIONS SET SORTH HEREIN.


TERMS AND CONDITIONS

The terms and conditions below govern the agreement between YOU and the COMPANY.  In the future, ubAlert may modify the terms and conditions set forth in this Agreement and/or in the Policies. All such changes shall become effective once posted to the company web site.

The online network’s availability and proper functioning of the communication lines are required for effective delivery of SERVICES.  Availability and proper functioning of the network, however, is beyond the control of ubAlert.  Online network may NOT be available, OR may NOT be supported, in some countries and/or some languages.  Additionally, online network may not be available due to maintenance or upgrades.

ubAlert will NOT be held responsible or liable for failure, delayed delivery of, or any other problems in providing SERVICES that are attributed to or caused by disruption of ONLINE NETWORK for any reason.


Alerts and Notifications

Alerts and notifications about incidents, hazards, and potential disasters are meant to provide situational awareness about potential hazards, but they are NOT meant to be used as the sole source of information for action.  ubAlert does its best to ensure accuracy and timeliness of the information, as described below.  YOU must always verify the accuracy of the information from a different independent source before acting on the information.

ubAlert does its foremost to ensure that the alert information posted to its site is accurate and reliable.  ubAlert is not a news agency and does not normally originate stories.  Much of the information is gathered from various governmental and/or international agencies, news organizations, university programs, and/or third party information integrators and suppliers that are deemed official, accurate, and reliable.  Likewise, ubAlert’s online code of conduct and terms are set to ensure that registered user reported content is free of offensive context, and is most accurate.  However, ubAlert cannot monitor all content and/or offer any guarantees regarding the context, and therefore will not be held liable for the accuracy, timeliness, or context of the posted alerts, information, and/or products.

ubAlert does not normally originate news stories, but reports information from other sources that are deemed accurate.  ubAlert will not be held responsible for the accuracy and/or timeliness of the notification or other information provided by the sources.  YOU, and the users of the SERVICES are expected to understand the context for the information, and consult sources independent of ubAlert to verify accuracy and determine courses of action.

Therefore, ubAlert will not be held responsible or liable for any misuse of, or any action taken by YOU or other users that may be based on any of the company SERVICES.   Likewise, the COMPANY will not be held responsible for any lack of action or misuse of information by YOU or other users attributed to any of the company services’ availability or unavailability.


Alert Delivery

ubAlert uses different media and networks to deliver its alerts and notifications.  Successful and timely delivery of these alerts depends on availability of ONLINE NETWORK.  ubAlert assumes no responsibility for missed, delayed, or otherwise unsuccessful delivery due to NETWORK downtimes and/or unavailability.

In order to limit the number of notifications, ubAlert relies on scientific models and/or user-reports to estimate the potential impact areas.  YOU and the users must be aware that these are all different methods for estimation, and by definition, do include margins of errors.  The impact area, therefore, will never be free of error, nor that will it ever be exact.

As such, ubAlert will not be held responsible or liable for any misuse of the information, or any action taken (or not taken) by YOU or other users that may be based on alert delivery and/or the potential impact area, whether produced by scientific modeling and/or estimated by another user.


Registered Users

In order to examine accuracy of the information reported by the users, ubAlert only allows registered users to create alerts.  Registered users are bound by the User Account policies, terms, and conditions set forth herein.  ubAlert reserves the right, by its sole discretion, to terminate registration of a user account deemed solely by ubAlert to in violation of any of the company’s policies, terms, condition, or code of conduct.


User Account policies, Terms, and Conditions

You must create an appropriate ubAlert account to benefit from many of company services offered only to the registered users.  ubAlert accounts are FREE of charge, but you may be charged for SERVICES for which you explicitly register.  Charged services will NOT be initiated unless YOU explicitly sign up for them AFTER an account is created.

All the information you give us during this account registration must be truthful and accurate.  The user information is kept private and confidential by the company, and will be governed by our Privacy Policies.  ubAlert may refuse a request for registration at its discretion.

Your account (or careen) name will be publicly available, displayed on comments, alerts, or other screens.  All other information is kept confidential by the company, unless you explicitly share with others.

FOR YOUR PROTECTION, THE FOLLOWING POLICIES, TERMS, AND CONDITIONS APPLY TO ALL ACCOUNTS:

We are not responsible and accept no liability to you for the activity of other ubAlert users or for material published the online network.


Privacy Policy

ubAlert takes all reasonable measures to protect all user data.

ubAlert does not disclose, sell, or rent user account data without user's prior consent or unless required by order of a court, administrative agency, or other applicable law. In order to provide the services, ubAlert may have to disclose part or full user account data to a) ubAlert personnel who manage accounts in connection with the services;  and/or b) service providers that take role in providing functions or services related to the services, if any.  Except as otherwise set forth herein, ubAlert will not provide any user data to any third party without the user’s authorization.


Governing Law

To the extent permitted by applicable law, these Conditions are governed by and interpreted in accordance with the laws of State of Hawaii, U.S.


Warranty Disclaimer

Other than as set out in these Conditions, ubAlert offers no warranty about the quality, functionality, availability, completeness, accuracy or performance of any of its services.
